The following terms and conditions apply to the sale of products purchased from Verax International Limited ('Verax' or 'We') on this site.

We want you to understand the basis upon which you buy products from us.

Customer satisfaction is our number one priority. HOW TO BUY FROM US

Making a purchase is straightforward. Just browse our store and add the items to your list that you wish to buy into your shopping cart. Once you have finished your selection, click on 'Check Out'. We will then request a few details from you in order to complete the order.

 

ORDERING ALLOWS US TO USE YOUR PERSONAL DATA

By submitting your order you are also allowing us to use your personal details for the purposes of supplying the goods or services concerned (including passing your details onto couriers and other subcontractors for the purpose of fulfilling your order).

The basis upon which we obtain and use personal data for this and other purposes is set out in our Privacy Statement reproduced below.

 

HOW TO PAY

We accept the following card types: Delta, Switch, Access, Visa, Solo, Mastercard and Maestro, using our secure PayPal site.

We do not charge for any item until it is ready to ship. Back ordered items are not charged until they are shipped. When shopping from outside the United Kingdom, your credit card company will convert the transaction to your own currency. We have no responsibility for this conversion process.

Once you have placed your order we will send you an email to acknowledge this. This is purely to advise that we have received your order and does not indicate that a contract exists between us.

We will indicate acceptance of your order when we send you an invoice and hence a contract exists between us.

 

BACK ORDERS

If any Goods you have ordered are not in stock, we will place these on back order for you and notify you via e-mail. If you do not wish to wait, you will have the option to cancel the back ordered Goods. You must cancel within 1 working day of receipt of such notification otherwise you will be deemed to have agreed to the Back Order. Back Orders will only be charged when we send you the Goods.

 

VALUE ADDED TAX ('VAT')

Our prices (including delivery charges where applicable) do not include VAT, which is chargeable at 20% in the UK. VAT is also chargeable (at 20%) on all goods shipped to EU countries unless customers provide their VAT/tax number on headed paper or an official document. When a user in an EU country, other than the UK, provides a valid VAT number then the Total excluding VAT applies.

Books in general are 0% VAT rated in the U.K. However, when a book contains electronic media - disks, CD ROMs etc. then VAT applies to the proportion of the charge which is for the electronic media.

 

SHIPPING & HANDLING & DELIVERY SCHEDULE

Normal 7 day delivery to mainland UK addresses is non-chargeable. We endeavour to ensure that your goods are delivered to you within 7 days.

Our priority is to get your products to you as quickly as possible but we will not be liable to you for late delivery as we are dependent on our shippers.

Please note that customers who require delivery of their goods by overnight courier or same-day delivery will need to pay a special delivery charge, details of which we can advise by telephone.

Overseas deliveries will incur shipping fees. All delivery times are estimates only. In some instances, such as where goods are not in stock, delivery may take up to 28 days or longer.

An exact cost of shipping will be calculated for you prior to your reaching the checkout and this will be added to the price of your goods. Once your order has been picked and packed, we will arrange to ship your goods via our approved provider. You will receive an e-mail to notify you of this including the shipping tracking reference.

If you wish to make alternative arrangements for delivery of the goods, please contact us to make mutually agreeable arrangements.

 

RETURNS

DAMAGED OR FAULTY GOODS

Verax makes best endeavours to ensure that our goods reach you in adequate condition. However please inspect your order when you receive it for any defects or damage. If you find a defect or any damage please contact us as soon as possible.

Please return the defective or damaged goods to us by post and we will arrange for a replacement of the goods to be sent to you. Verax will refund any costs incurred by you for postage and packaging and all replacement goods will be sent to you free of further charges.

You consent to our inspecting any returned goods to ascertain whether the goods are faulty and upon receipt of your return Verax will inspect all goods. In the event we find no fault, we reserve the right to charge you for returning the item(s) to you.

 

INCORRECT GOODS

If you have received incorrect goods, please send them back to us and we will re-issue the correct goods and pay for all postage and packaging charges incurred by you.

 

EXCHANGES

We cannot offer exchanges (i.e. swapping a Verax product for another) once goods have been ordered by you or delivered to you.

 

YOUR RIGHTS UNDER THE DISTANCE SELLING REGULATIONS (2000)

Under the Distance Selling Regulations (2000) you have the right to cancel the contract relating to your order at any time up to the end of 7 working days after your goods are delivered. To exercise your right of cancellation, you must give written notice to Verax by letter, fax or e-mail setting out details of the goods ordered and the date received. Notification by phone is not acceptable.

If you exercise your right of cancellation under the Distance Selling Regulations (2000) after the goods have been delivered to you, you will be responsible for returning the goods to Verax at your own cost. The Distance Selling Regulations (2000) places a duty on you to take reasonable care of the goods once you have exercised your right to cancel. Returned items must be packaged properly and shipped in a plain outer box.

Verax will refund you within 30 days for any sum that has been paid by you or debited from your credit or debit card for the goods. If after exercising your right under the Distance Selling Regulations (2000) you do not return the goods as required, Verax may charge you a sum not exceeding the direct costs of recovering the goods.

When exercising your right to cancel under the Distance Selling Regulations (2000) please return goods to Verax International Limited, Centaur House, Ancells Business Park, Ancells Road, Fleet, Hampshire,  GU51 2UJ, U.K.

 

EXCEPTIONS TO DISTANCE SELLING REGULATIONS (2000)

You do not have the right to cancel the Contract under the Distance Selling Regulations (2000) if you have collected goods or if the order is for computer software that has been unsealed, or if you are not a consumer i.e. a company, partnership, sole trader or any other commercial body or registered charity. SOFTWARE LICENCES

All Verax Software is Licensed, not sold to the Customer. This agreement will set out your rights as a user of such software, including the right for assistance from one of Verax's IT team or a nominated distributor.

Verax International Limited owns all intellectual property in the software. The software is the intellectual property of and is owned by Verax International. The structure, organisation and code of the software are the valuable trade secrets and any confidential information of Verax International Limited. The software is protected by law, including but not limited to the copyright laws of the United Kingdom and other countries, and by intellectual treaty provisions. Except as expressly stated herein, this Agreement does not grant you any intellectual property rights in the software and all rights not expressly granted are reserved by Verax International Limited.

 

PLEASE CHECK YOUR SOFTWARE ORDER CAREFULLY

In a fast moving sector such as software it is your responsibility to refer to the most recent software product description and the most recent product pricing when placing your order.

 

SECURITY

ORDERING ONLINE

The Verax online order system encrypts all your personal information including your name, address and credit or debit card details using industry standard secure socket layer (SSL) technology. This is intended to ensure that information passed between your computer and this site cannot be read in the unlikely event that it is intercepted by someone else. However Verax expressly exclude liability incurred as a result of fraud carried on by third parties.

 

COOKIES

A cookie is a small item of information which websites can use to both store and retrieve information via the client's browser. Your browser will only release this information to the site that issued it. This site makes use of cookies to store information that is used to re-fill request forms and orders for ease of use. If you do not accept or you erase these cookies, you may be required to log in manually to gain access to certain features of the site.

 

RISK

Risk of loss or damage to the goods passes to you immediately after delivery. You should insure the Goods against all usual risks accordingly.

 

E-MAILS

When you use this site we may need to communicate with you by e-mail.

Our e-mails (including any attachments to them) may contain information that is confidential or legally privileged and intended only to be seen by a particular person or persons.

If you know that you are not the intended recipient of an e-mail or it is reasonably obvious that you are not the intended recipient, please note that any onward disclosure, copying, distribution or any use made of it (and any attachments) is prohibited and may be unlawful.

If you are not the intended recipient of an e-mail or attachment please notify the sender immediately and then delete the original e-mail received and any attachment without making any copies or using the same in any other way.

 

E-MAIL LIABILITY

E-mail transmission cannot be guaranteed to be secure or error free for many reasons, for example, information can be intercepted, corrupted, lost, destroyed, delayed or be incomplete or contain viruses.

You should always carry out your own virus check before opening any attachment.

E-mails and any files attached to them have been checked with virus detection software before transmission. However, Verax accepts no liability for any loss or damage which may be caused by viruses or other pernicious code or third party action.

 

PROVISION OF INFORMATION ABOUT PRODUCTS

All and any information about the products on this site is provided by Verax in good faith. The information on this site is not warranted to be complete or up to date and may be altered without notice at the discretion of Verax.

 

NO WARRANTIES

We do not warrant that any products sold to you will meet your requirements or that their operation will be uninterrupted or error free.

Customers must accept that it is their responsibility to select how all goods meet their specific requirements and also that software cannot be tested in every possible combination or operating environment.

If you need a contractually binding term or condition relating to a particular product then you must before you order provide us with all relevant information and details of precisely what assurance you are seeking. However you do need to obtain our separate written unambiguous agreement to the term or condition concerned and we can withhold our agreement to it at our entire discretion and without giving reasons.

 

EXCLUSION OF LIABILITY

Verax excludes all express and implied warranties or conditions relating to the products and services that we sell whether via this site or otherwise. The only exceptions being:

• if those warranties or conditions are clearly stated on this site as being applicable to the sale of the relevant product or provision of the service concerned.
• if the warranties and conditions are contained in a separate written agreement between us which we have agreed are to be contractually binding on us;
• that we do not exclude our liability for death or personal injury caused by our negligence or liability based on a proven claim against us of fraudulent misrepresentation; and
• The above policy does not affect any statutory rights that are available to you to the extent that such rights are incapable of being excluded by law.

LIMITATION OF LIABILITY

Our liability to you for any losses and costs connected with the sale of products or services to you shall not exceed the amount you originally paid us for the products or services in respect of which your claim relates.

In no event will we be liable to you for any indirect or consequential damages (including but not limited to loss of profits, business, revenue or goodwill) even if we have been advised of the possibility of such damages. In particular without limiting the generality of the foregoing we accept no liability for any defective programs, code or loss or corruption of data made or stored using products obtained from us nor for the costs of recovering or replacing such programs, code or data.

Verax will not be liable to you for any injury or accident sustained as a result of using and/or reading our literature and/or products.

Nothing in this statement limits our liability to you in the event of death or personal injury resulting from our negligence or based on a proven claim against us of fraudulent misrepresentation.

 

TRADEMARKS

You are not licensed to use any Verax trademarks except with the express permission of Verax. Other trademarks of software suppliers may also be displayed on our site from time to time. Supplier material may be subject to trademark and copyright restrictions imposed by the software supplier.

 

INTELLECTUAL PROPERTY

Except where otherwise identified the programming of this site and images and text on it are the copyright and/or database right of Verax. You are not licensed to use any Verax or third party copyright or database right except with the express permission of Verax or as may be implied by virtue of your visiting the site to acquire goods and services offered on it.

 

JURISDICTION

This site is controlled and operated from England. The terms and conditions of this site and any dispute about them or in relation to this site shall be governed by and subject to English Law. In the event that a dispute arises out of or relating to these terms and conditions or the use of or access to this site, such dispute shall be subject to the exclusivity of the English Court.

 

PRIVACY STATEMENT

Verax is registered with the United Kingdom Data Protection Registrar and is committed to dealing with personal data in the spirit of the Data Protection Act 1998 ("the Act").

Verax holds a current Data Protection registration which may be inspected at https://ico.org.uk/esdwebpages/search.

We only collect information about you that you provide us with during the ordering or registration process whether you do this online or by other approved methods.

We collect this information to enable us to process your orders in an efficient manner and to assist us in seeking to provide a high quality service to you. We also use it for the other purposes set out in this Privacy Statement.

Once we have confirmation that your order has been delivered, we destroy by secure means all your credit card details relating to any particular transaction. We do not store any credit card details in electronic format.

Verax agrees not to pass your personal data on to any third parties save for the purposes of supplying the goods concerned which may include passing your details to suppliers, couriers and other sub-contractors for the purpose of fulfilling your orders.

Verax keeps in close contact with its customers informing them of service level improvements and new product information by its free subscription services and by direct mailing or emailing to our customers or prospective customers.

Verax may consider it necessary to contact you by email, post or telephone in relation to any business related matter including service level improvements and new product information and you consent that we may do so. If you do not want to be contacted in this way for any of those purposes then please get in contact and let us know.

You also consent that we may track your use of the site and use any cookies or personal data for the provision of demographic information of an aggregated and collective nature for our own analysis of commercial trends, site usage and other similar research and statistics. You also consent that we may share this with third parties in an anonymous format that does not allow you to be identified.
